Subject: Information on the processing of personal data collected from the data subject via the website

In compliance with the provisions of Reg. EU 2016/679 (European Regulations for the protection of personal data) We provide the necessary information regarding the processing of personal data provided.

The information must not be considered valid for other websites that may be consulted through links on the domain websites of the holder, which are not to be considered in any way responsible for third party websites.

By consulting the site, data relating to identified or identifiable persons may be processed. This page describes how to manage the site in relation to the processing of the personal data of the users who consult it

This information is provided pursuant to Article 13 of the Reg. EU 2016/679 (European Regulation for the protection of personal data) and is also based on the provisions of Directive 2002/58/EC, as updated by Directive 2009/136/EC, on Cookies as well as the provisions of the Personal Data Protection Authority for the protection of personal data of 05.08.2014 concerning cookies.

1. DATA SUBJECTS

The data controller, to whom you can contact to enforce the rights transcribed above, BIG BLU SPORT SRL, with legal and operational headquarters in Via Dell’artigianato n. 2, Castellina in Chianti (SI).

2. PURPOSE AND LAWFULNESS OF THE PROCESSING
   The personal data provided will be processed in compliance with the conditions of lawfulness pursuant to Article 6 of the Reg. EU 2016/679 for the following purposes:a) Inherent data processing management (Article 6b)):
   • Browsing on this website;
   • possible compilation of data collection form for sending an information request to the data controller;
   • fulfilment of contractual obligations, of law and administrative-accounting purposes. For the purposes of the application of the provisions regarding the protection of personal data, the processing performed for administrative-accounting purposes relate to the performance of organizational, administrative, financial and accounting activities, regardless of the nature of the processed data.
3. BROWSING DATA

This website, like all websites, also makes use of log files in which information collected in an automated manner is kept during user visits. The information collected could be the following:

• internet protocol (IP) address;
• type of browser and device parameters used to connect to the site;
• Internet service provider (ISP) name;
• date and time of visit;
• web page of origin of the visitor (referral) and exit web page;
• number of clicks, if necessary.

This information is not collected to be associated with the identified data subject, but which could, by their very nature, through the processing and association with data held by third parties, allow users to be identified.

The data could be used to ascertain responsibility in the event of hypothetical computer crimes against the site: with the exception of this eventuality, at present the data on web contacts do not last for more than seven days.

4. DATA PROVIDED VOLUNTARILY BY THE USER

The optional, explicit and voluntary sending of comments to the e-mail addresses listed on this website involves the subsequent acquisition of the sender’s address, which is needed to respond to requests, as well as any other personal data included in the message.

5. COOKIES

There are no cookies (small text files that allow you to preserve information about visitor preferences, to improve the functionality of the site). 

6. RECIPIENTS OR CATEGORIES OF DATA RECIPIENTS

The personal data provided may be disclosed to recipients, named pursuant to Article 28 of the Reg. EU 2016/679, which will process data as managers and/or as natural persons acting under the authority of the Data Controller and the Data Processor, in order to comply with contracts or related purposes. Specifically, the data may be disclosed to recipients belonging to the following categories:

• Subjects providing services for the management of the information system and communication networks of BIG BLU SPORT SRL. (including e-mail);
• Studies or companies in the area of assistance and consultancy relationships;
• Competent authorities for the fulfilment of legal obligations and/or provisions of public bodies, upon request;
• In case of administrative and accounting purposes, the data may eventually be sent to commercial information companies for the assessment of solvency and payment habits and/or subjects for the purposes of debt collection.
• In the case of application, your data will be stored at our office and will be communicated exclusively to the subjects responsible for carrying out the necessary services, with a guarantee of protection of the rights of the data subject. Your data will only be processed by personnel expressly authorized by the Owner and, particularly, by the following categories of subjects in charge:
  • BIG BLU SPORT SRL Management and Administration with System and Management Administrator and Personnel Administration duties

The subjects belonging to the aforementioned categories perform the duty of Data Processor, or operate in complete autonomy as separate Data Controllers

7. DATA CONTROLLER

The data collected by the site are processed at the headquarters of the Data Controller, and at the Web Hosting datacenter. Web hosting, which is responsible for processing the data, processing data on behalf of the holder, is located in the European Economic Area and acts in accordance with European standards.

The list of designated data processors is constantly updated and available at the headquarters of BIG BLU SPORT SRL.

8. DATA TRANSFER TO A THIRD COUNTRY AND/OR AN INTERNATIONAL ORGANISATION

The personal data provided will not be transferred abroad inside or outside the European Union.

9. RETENTION PERIOD OR CRITERIA

The processing will be carried out in an automated and/or manual manner, with methods and tools aimed at guaranteeing maximum security and confidentiality, by subjects specifically appointed to do so.

In compliance with the provisions of Article  5 paragraph 1 letter e) of the Reg. EU 2016/679 the personal data collected will be stored in a form that allows the data subjects to be identified for a period of time not exceeding the achievement of the purposes for which the personal data was processed. 10. NATURE OF THE PROVISION AND REFUSAL

Apart from what is specified for browsing data, the user is free to provide personal data in dedicated areas on the site.

The provision of personal data for the purposes referred to in paragraph a) of this information document is necessary in order to refine the specific features and use the services offered to the Data Controller, for example to receive feedback to the request for forwarded information. Failure to provide personal data may make it impossible to obtain the requested service or to use the services offered by the site.

11. RIGHTS OF THE DATA SUBJECTS

You can assert your rights as expressed in Articles 15 – right of access, 16 – right to rectification, 17 – right to cancellation, 18 – right to limitation of treatment, 20 – right to portability, 21 – right of opposition, 22 right to oppose the automated decision-making process of GDPR 679/16 of the EU 2016/679 Regulation, by contacting the Data Controller, writing to info@bigblugroup.it .

You have the right, at any time, to ask the Data Controller to access your personal data, to rectify it, to cancel it or limit its processing.

Furthermore, you have the right to object, at any time, to the processing of your data (including automated processing, e.g. profiling), and to the portability of your data.

Without prejudice to any other administrative and judicial remedy, if you consider that the processing of data that concerns you, violates the provisions of Reg. EU 2016/679, pursuant to Article 15f) of the aforementioned Reg. EU 2016/679,

You have the right to lodge a complaint with the Personal Data Protection Authority and, with reference to Article 6 paragraph 1a) and Article 9, paragraph 2a), have the right to revoke consent at any given time. In the event of requesting data portability, the Data Controller will provide you in a structured format, commonly used and legible, by automatic device, the personal data concerning you, without prejudice to paragraphs 3 and 4 of the Article 20 of the Reg. EU 2016/679.
